Carmelo Cruz Marcos
Killed · CBP · Skeleton Canyon near Douglas, Arizona
What happened
Two horse-patrol agents intercepted a migrant group northeast of Douglas. Staheli pursued Cruz Marcos, 32; after a struggle in rugged terrain, Staheli shot him. Autopsy showed multiple gunshot wounds. The case drew scrutiny after fellow migrants alleged agents discussed a cover story and moved evidence.
Resistance to arrest
Agent said Cruz Marcos resisted capture, punched him, then picked up a rock and made a throwing motion. Fellow migrants alleged agents discussed a cover story. A county prosecutor later declined charges, finding the shooting appeared justified under Arizona law—while the resistance narrative remains contested by witnesses.
Officer / agency involvement
Border Patrol Agent Kendrek Bybee Staheli fired multiple rounds after a foot chase/struggle.
Official / DHS account
Agent said Cruz Marcos punched him, fled a short distance, picked up a large rock, and made a throwing motion; Staheli fired in fear for his life.
Contested points & other evidence
Other migrants told investigators they heard agents coach a rock-attack narrative and alleged evidence tampering (Intercept / sheriff file). Cochise County Attorney later declined charges, finding the shooting appeared justified under Arizona law.
Investigation status
Cochise County Attorney declined prosecution (May 2022); CBP OPR / use-of-force review also reported. No criminal charges against the agent.

How to read source labels
News outlets are tagged with a perceived lean (liberal, conservative, or neutral)—a simplified reading of common media-bias charts, not a verdict on accuracy. Official records (court filings, prosecutor releases, agency statements, legislative text) are listed separately and are not scored as “news,” though governments and prosecutors also have interests.
